Probate Reforms Expected To Emerge Autumn 2016
Earlier this month the Government proposed a new fee regime for applications for probate. The fee that was previously a flat rate is likely to become a banded fee structure rising with the value of the estate. The proposal also includes plans to increase the value of the fee payable threshold from £5000 to £50,000.
The Government has said the main aim of the changes is to make the system more progressive and fair.
In its December 2015 spending review the Government announced it would be making an investment of £700 million to reform Her Majesty’s Courts & Tribunals Service over the next 5 years. It is estimated that these proposals for probate reform will raise around £250 million a year and it has been reported in the Law Society Gazette that the probate reforms are expected to emerge during Autumn 2016.
