As a result of a recent Judicial Review, the Legal Aid Agency has rolled back scheme 10 of the Litigators’ Graduated Fee Scheme (LGFS) which was implemented on 1 December 2017. With immediate effect the Legal Agency’s digital team removed fee scheme 10 from all relevant systems and announced that any fee claimed or redetermined going forward will be claimed and assessed under the previous fee scheme.

graphic of calendar sheet showing December 2017Select Legal Systems Limited have updated LAWFUSION accordingly to allow users to continue to accurately submit their LGFS claims. The Litigators’ Graduated Fee Scheme (LGFS) remunerates litigators for Crown Court work and it was introduced in 2008. In December 2017 the Government capped the number of claimable ‘pages of prosecution evidence ‘(PPE) from 10,000 to 6,000 for LGFS. From this date pages above 6,000 had to be claimed as special preparation. The High Court quashed the regulation on 3-8-18 and ruled that the Ministry of Justice’s failure to disclose the statistical analysis underpinning the decision made the consultation unfair.
